Así, se ha extendido el ámbito de aplicación de la norma también a los trabajadores de la provincia de Huaral. Además, se ha dispuesto la realización de teletrabajo en Lima Metropolitana, la Provincia Constitucional del Callao y la provincia de Huaral los días 11, 12 y 13 de noviembre del 2024 en el sector público. El día martes 24 de setiembre de 2024 se publicó la Ley No. 32123 que tiene como objeto crear el Sistema Integral Previsional Peruano, incorporando tanto el Sistema Nacional de Pensiones y el Sistema Privado de Pensiones.
Los principales cambios se ven reflejadas en lo siguiente:
- Conforme establece el artículo 12.3 de la Ley No. 32123 la edad para acceder a una pensión anticipada es a partir de la edad de 55 años. Asimismo, la diferencia radica en que el Decreto Supremo 054-97-TR en su artículo 42 señala que procede la jubilación cuando el afiliado es mayor a 50 años.
- Conforme establece el artículo décimo quinto de las disposiciones complementarias finales de la Ley No. 32123 que las personas menores a 40 años no podrán retirar los fondos disponibles en su Cuenta Individual de Capitalización (CIC). Por otra parte, las personas que tengan 40 años o más podrán retirar hasta el 95.5% de su CIC.
- El artículo 9 de la Ley No. 32123 incorpora la tasa de aporte para los trabajadores independientes, teniendo una tasa progresiva inicial del 2% hasta el 5%.
- El artículo 45 de la Ley No. 32123 aclara que a falta de herederos, el saldo pasa a ser de propiedad de la Oficina Nacional de Pensiones después de diez años de no ser reclamado. Asimismo, el artículo 45 del Decreto Supremo 054-97-EF indicaba que la norma anteriormente citaba que a falta de herederos, el saldo pasaba a integrar el Fondo, distribuyéndose en montos iguales entre la totalidad de Cuentas Individuales de Capitalización de la correspondiente AFP.
